This website and mobile applications are operated by Ebakkie Pty Ltd. Throughout the site and apps, the terms "we," "us," and "our" refer to Ebakkie Pty Ltd. By using our site or apps, you agree to be bound by the following terms and conditions ("Terms of Service"). These Terms of Service apply to all users of the site and apps, including browsers, vendors, customers, merchants, drivers, and contributors of content.
1. Acceptance of Terms
Please read these Terms of Service carefully before accessing or using our website or mobile applications. By accessing or using any part of the site or apps, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. Any new features or tools added to the current platform shall also be subject to the Terms of Service. We reserve the right to update, change, or replace any part of these Terms of Service by posting updates to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website or apps following the posting of any changes constitutes acceptance of those changes.
2. Eligibility
By agreeing to these Terms of Service, you represent that you are at least 18 years of age, which is the age of legal majority in South Africa, or that you have obtained consent from a parent or guardian. We reserve the right to refuse service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission from us.
3. Service Description
eBakkie is a technology platform that connects customers who need transportation and delivery services with independent bakkie, truck, and delivery vehicle owners/drivers ("Drivers"). We provide the following services through our website and mobile applications:
- On-demand ride-hailing for goods transportation and moving
- Scheduled delivery bookings
- Real-time GPS tracking of rides and deliveries
- In-app messaging between customers and drivers
- Secure payment processing (card, wallet, cash)
- Driver and customer rating system
- Merchant/business API for automated delivery requests
Important: eBakkie does not own, operate, or control any of the vehicles or drivers that use our platform. Drivers are independent service providers, not employees of eBakkie. We act solely as an intermediary connecting customers with drivers.
4. User Accounts
To use certain features of our Service, you must create an account. You may register using your email address, phone number (via OTP verification), or social login (Google, Apple). You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Providing accurate and up-to-date personal information
- Notifying us immediately of any unauthorised use of your account
5. Driver Requirements
Drivers who wish to offer services through our platform must:
- Be at least 18 years of age and hold a valid South African driver's licence
- Upload a profile photograph and driver's licence documents for verification
- Register at least one vehicle with valid details and documentation
- Complete the onboarding process and receive admin approval before accepting rides
- Maintain an acceptable rating and conduct standard
- Comply with all applicable traffic laws and regulations
6. Payments & Pricing
Ride fares are calculated based on distance, estimated duration, vehicle type, and any applicable surcharges. The estimated fare is shown before booking confirmation. Payment methods include:
- Card payments: Processed securely via PayStack. eBakkie does not store card details.
- eBakkie Wallet: Prepaid balance funded via card top-up.
- Cash: Paid directly to the driver upon delivery. Platform commission is deducted from the driver's wallet balance.
All prices are displayed in South African Rand (ZAR). The actual fare may differ from the estimate based on the actual route taken, traffic conditions, and waiting time. Fare adjustments are subject to configurable thresholds set by eBakkie.
7. Cancellation Policy
Rides may be cancelled by either the customer or driver. Cancellation fees may apply depending on the timing and circumstances:
- Cancellations within the grace period (as configured) are free of charge
- Late cancellations may incur a fee, which varies based on whether the driver has already arrived
- Repeated cancellations may result in temporary cooldowns or account suspension
- Refunds for card payments are processed according to our refund policy
8. Location Services
Our Service requires access to your device's location to function. By using our Service, you consent to the collection and use of your location data as described in our Privacy Policy. You can disable location services through your device settings, but this will prevent you from using core features of the app.
9. User Conduct
Users are expected to use our services responsibly. You agree NOT to:
- Use the Service for any unlawful or unauthorised purpose
- Harass, threaten, or abuse other users, drivers, or eBakkie staff
- Provide false information during registration or booking
- Interfere with or disrupt the Service or its infrastructure
- Attempt to gain unauthorised access to other users' accounts
- Use the Service to transport illegal goods or substances
- Manipulate ratings, reviews, or feedback systems
- Resell or commercially exploit the Service without written permission
10. Ratings & Reviews
After each completed ride, both customers and drivers may rate each other and provide written feedback. Ratings are used to maintain service quality. Users with consistently low ratings may have their accounts reviewed or suspended. All feedback must be honest and constructive.
11. Merchant & API Access
Businesses may register as merchants to access the eBakkie API for automated delivery requests. Merchant accounts require admin approval. API keys are provided for authenticated access to delivery endpoints. Merchants are responsible for the security of their API keys and all requests made using them.
12. User Content
Users are solely responsible for the content they submit through our platform, including profile photos, delivery proof images, chat messages, ratings, and feedback. By submitting content, you grant us a non-exclusive, royalty-free, transferable, and sublicensable licence to use, modify, and reproduce the content for the purpose of providing our services.
13. Intellectual Property
Our platform, including all content, logos, design elements, software, and intellectual property, is owned by Ebakkie Pty Ltd and/or our licensors. The eBakkie name, logo, and brand are registered trademarks. Users may not copy, modify, distribute, or reproduce any content or intellectual property without our prior written consent.
14. Disclaimers
We do not guarantee the availability, reliability, or quality of any services provided by drivers using our platform. eBakkie is a technology platform and is not a transportation or delivery company. We are not responsible for:
- The actions, conduct, or negligence of any driver
- Damage to goods during transportation
- Delays caused by traffic, weather, or other circumstances beyond our control
- The accuracy of estimated fares or arrival times
Our platform is provided "as is" and without any warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
15. Limitation of Liability
To the maximum extent permitted by South African law, in no event shall Ebakkie Pty Ltd, its directors, employees, partners, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of our services, whether or not we have been advised of the possibility of such damages. Our total liability shall not exceed the amount paid by you to eBakkie in the 12 months preceding the event giving rise to the liability.
16. Indemnification
You agree to indemnify, defend, and hold harmless Ebakkie Pty Ltd and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.
17. SOS & Safety
Our platform includes an SOS feature that allows users to raise emergency alerts during rides. When activated, the SOS alert shares the user's real-time location with our support team. eBakkie will make reasonable efforts to respond to SOS alerts but is not a substitute for emergency services. In case of immediate danger, please contact the South African Police Service (SAPS) at 10111 or emergency services at 112.
18. Termination
We reserve the right to suspend or terminate a user's access to our platform at any time, without prior notice, for any reason including but not limited to violation of these Terms, fraud, safety concerns, or excessive cancellations. Users may also terminate their account at any time by deleting their account through the app or contacting support.
19. Dispute Resolution
Any disputes arising from the use of our Service shall first be addressed through our internal complaints process. If a dispute cannot be resolved informally, it shall be submitted to mediation or arbitration in accordance with the laws of South Africa before resorting to litigation.
20. Governing Law
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Republic of South Africa. The courts of South Africa shall have exclusive jurisdiction over any disputes arising from these Terms.
21. Amendments
We reserve the right to update these Terms and Conditions at any time. Material changes will be communicated via email or in-app notification. Users are advised to review these Terms periodically to stay informed of any changes. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
